Terms of Service (ToS)

Welcome to "Cruising". Please read these terms carefully.

§ 1 Scope

(1) These Terms of Service (hereinafter "ToS") govern the contractual relationship between the operator of the "Cruising" app (hereinafter "Provider" or "we") and the users of the app (hereinafter "User").

(2) By installing, registering, and using the app, the user explicitly agrees to these ToS. If you do not agree to these terms, you may not use the app.

§ 2 Description of Services & Availability

(1) "Cruising" is a mobile application for documenting drives, recording telemetry data (times, speeds), tracking free drives ("Free Drive"), planning group drives with other users, maintaining a virtual vehicle garage, and interacting with other users via leaderboards and unlockable achievements (milestones based on your own driving history).

(2) No Guarantee of Availability: We strive to ensure constant availability of our services. However, temporary outages due to maintenance, server issues (e.g., Google Firebase, Mapbox), or lack of mobile network coverage cannot be ruled out. There is no entitlement to uninterrupted use.

(3) Right to Make Changes: The Provider is entitled to modify, expand, or discontinue features of the app at any time. Updates may be required to continue using the app.

§ 3 Safety Instructions & Personal Responsibility

(1) Priority of Traffic Laws: The use of the app is at your own risk. The information displayed (e.g., best times, average speeds, maps, recorded routes) is solely for entertainment and documentation purposes. It does not exempt the user from the strict obligation to always comply with traffic regulations and applicable speed limits.

(2) No Distraction: Interacting with the app (e.g., starting a route, naming a drive, managing the garage, writing comments) must not be done by the driver while driving, but only when the vehicle is safely parked or by a passenger.

(3) Prohibition of Illegal Racing: The app is expressly not a platform for, nor an encouragement to, commit speeding violations, endanger road traffic, or participate in illegal motor vehicle races. Naming drives must not be abused to glorify illegal street racing. Leaderboards and route recordings serve to compare drives under legal conditions.

(4) Personal Judgment: Structural conditions, weather, and real traffic situations always take precedence over app navigation. Users who abuse the app for illegal purposes or risky driving behavior will be permanently banned from the platform.

(5) Meeting Other Users: When planning or joining group drives, you may meet other users in person. This happens at your own responsibility. The Provider takes no responsibility for the behavior, identity, or driving conduct of other users, and recommends meeting at public, busy locations first.

§ 4 Eligibility

(1) The minimum age to create an account is 13 years. Minors require the consent of their legal guardians.

(2) Anyone actively using the app as a driver of a motor vehicle on public roads warrants that they hold a valid driver's license and that the vehicle used is registered and insured for road traffic according to applicable laws.

§ 5 License & Restrictions (Software)

(1) The user is granted a simple, non-transferable right to use the app for private purposes.

(2) The user is strictly prohibited from:

  • Copying, modifying, distributing, or selling the app or parts of it.
  • Circumventing technical protection measures or decrypting the source code (Reverse Engineering).
  • Automated reading of app data, leaderboards, or map material (Data Mining, Scraping) or using it for third-party services.
  • Intentionally impairing the app infrastructure through excessive load (e.g., spam requests).

§ 6 User Content, Leaderboards & Community Standards

(1) The user is solely responsible for the content they create (routes, driven times, recorded drives including naming, telemetry data, comments, vehicle pictures).

(2) It is forbidden to publish content that is unlawful, offensive, racist, pornographic, or violates the rights of third parties (e.g., foreign license plates on pictures). The same applies to spam or unsolicited advertising.

(3) Reporting System & Moderation: The app has a reporting function. Users can report inappropriate routes, recorded drives, comments, or unrealistic/dangerous best times to the administrators.

(4) The Provider exercises virtual domiciliary rights. We reserve the right to delete reported or suspicious content without prior notice and to temporarily or permanently suspend the accounts of offenders.

§ 7 Disclaimer of Warranties (Data & Technology)

(1) The app is provided "as is" and free of charge. The Provider assumes no warranty for the accuracy, completeness, and timeliness of the data provided, in particular not for:

  • GPS data, speed measurements, and timing (these depend on the smartphone's sensors and signal strength and may vary).
  • Map data, speed limits, and navigation instructions (these come from third-party providers like Mapbox and OpenStreetMap and may be outdated).
  • The continuous storage of telemetry data or recorded drives.

(2) Software defects do not justify a claim for subsequent performance or compensation for damages, provided they were not fraudulently concealed.

§ 8 Limitation of Liability

To the extent permitted by law, liability is limited as follows:

(1) The Provider is not liable for damages caused by slight negligence. This applies in particular to data loss, technical errors, faulty GPS recordings, or missed best times.

(2) The Provider is expressly not liable for fines, criminal charges, accidents, personal injuries, or damage to the vehicle that occur in temporal connection with the use of the app. The driver is solely and unconditionally responsible for their driving behavior.

(3) The aforementioned limitation of liability clauses do not apply to:

  • Intent or gross negligence on the part of the Provider.
  • Injury to life, body, or health based on a breach of duty by the Provider.
  • Breach of essential contractual obligations (cardinal duties), where liability is limited to the typically foreseeable damage.

§ 9 Privacy & Account Deletion

(1) Using the app requires the processing of personal data (in particular precise location data, email addresses, and user behavior). Details can be found in our Privacy Policy.

(2) If a user deletes their account in the app settings, their active access will be blocked immediately. The data will be archived in accordance with legal requirements for the preservation of evidence and subsequently completely anonymized or deleted.

§ 10 Changes to the ToS

We may change these ToS at any time if legal or technical adjustments (e.g., integration of new API providers or app features) require it. Continued use of the app after a change constitutes acceptance of the new terms.

§ 11 Final Provisions

The laws of the Federal Republic of Germany apply. The place of jurisdiction is, as far as legally permissible, the registered office of the Provider (Wolfsburg, Germany).
